On April 21, 2015 Judge Virginia Hernandez-Covington of the Middle District of Florida in Tampa issued a Consent Final Judgment in benefit of Sarasota based Capriola Corporation (as well as its exclusive intellectual property licensee Laser Pegs Ventures LLC). In that judgment, the Court found that U.S. Trademark Registration Nos. 3,770,530 and 4,299,368 for the LASER PEGS mark, as well as the slogan LIGHT IT UP – both in registered in International Class 28 – were valid and enforceable.. The Court further found that “both [marks are] strong, distinctive and have acquired secondary meaning in the marketplace.” Robert H. Thornburg served as lead trial counsel for both Capriola Corporation and its licensee Laser Pegs Ventures LLC. A copy of the Court’s order is attached hereto.
