A major change to the U.S. Patent and Trademark Office (USPTO) trademark application process starts Saturday. Applicants will now have only 3 months to respond to office actions issued after December 3, 2022, instead of the 6 months previously allowed. Applicants may request a 3-month extension to respond, provided they request the extension within the first 3 months and pay the appropriate fee. Only one extension of time is available.
ADD+G’s trademark attorneys continually monitor changes to USPTO rules, in addition to statutory and judicial developments in trademark law, to ensure our clients’ trademark rights are always properly protected. Our docketing and response procedures have already been adjusted to account for the new shortened response period.
