1. Introduction

This Privacy Policy describes how Allen, Dyer, Doppelt + Gilchrist, P.A. (“ADD+G,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information obtained through our website, allendyer.com (the “Site”). It applies to visitors, prospective clients, and clients who interact with the Site, and supplements — rather than replaces — any separate engagement agreement, confidentiality obligation, or attorney-client privilege that governs information you share with us as a client or prospective client.

This policy does not apply to information we collect offline or through channels other than the Site (for example, during a phone call with an attorney or in a signed engagement letter), which is governed by our professional and ethical obligations as a law firm.

2. Who We Are

Allen, Dyer, Doppelt + Gilchrist, P.A. is the controller responsible for personal information collected through the Site.

3. Information We Collect

(a) Information You Provide Directly

  • Contact and intake information submitted through our contact forms, phone calls, email, or in person, such as name, company, email address, phone number, mailing address, and the substance of your inquiry.
  • Your mobile phone number and related communications if you opt in to our SMS/text messaging program (see Section 12 and our separate SMS Terms and Conditions).
  • Information you submit to request a free resource or download (for example, “5 Ways You Can Lose Your IP Rights”).
  • Payment and billing information you submit through our third-party payment processor, LawPay, when paying an invoice online.

(b) Information Collected Automatically

When you visit the Site, we and our service providers automatically collect certain information through cookies, pixels, and similar technologies, including:

  • Log data: IP address, browser type, internet service provider, referring/exit pages, operating system, date/time stamps, and clickstream data.
  • Analytics data collected via Google Tag Manager and associated Google Analytics tags, describing how visitors use the Site.
  • Advertising data collected via the Meta (Facebook) Pixel, which shares certain browsing activity on our Site with Meta Platforms, Inc. for advertising measurement and, where you have not opted out, ad personalization.

(c) Information From Third Parties

We may receive limited information from third parties, such as payment confirmation from LawPay, or information from professional referral sources, legal directories (e.g., Best Lawyers, Super Lawyers), or publicly available sources.

4. Cookies and Similar Tracking Technologies

The Site uses the following categories of cookies and tracking technologies:

  • Strictly Necessary: required for the Site to function (for example, security and load balancing). These cannot be switched off.
  • Analytics: Google Tag Manager and Google Analytics, used to understand aggregate visitor behavior and improve the Site.
  • Advertising/Marketing: the Meta (Facebook) Pixel and related Google advertising tags, used to measure the effectiveness of our advertising and, where permitted, to show you relevant ads on other sites.

The tables below list the individual cookies and browser storage items used on the Site. Durations are approximate and, for third-party technologies, are set by the provider rather than by us. Third-party providers may also set additional cookies on their own domains, which we are not able to read or control, so these tables describe the technologies in use rather than every identifier a provider may create.

Two further advertising and analytics providers operate on the Site without placing any cookie or stored identifier of their own that we are able to observe. Simpli.fi (programmatic advertising) and Hotjar (session recording and heatmaps) each load only after you consent to the relevant category, and each receives your IP address, your browser user agent, and the page you are viewing. LinkedIn also operates on the Site; it sets no cookie of its own here, but does store the advertising identifier listed in the Browser Storage table below.

Browser Storage

Some of the technologies above also store information in your browser’s local storage and session storage rather than in cookies. This matters in one practical respect: clearing your cookies does not remove local storage, so an identifier held there can still recognize your browser afterward. Clearing your browser’s site data for this Site removes both.

Your Choices. You can manage non-essential cookies at any time through the cookie preference tool available in the Site footer (“Cookie Preferences”), which lets you accept or reject Analytics and Advertising cookies by category. Where required by law — for example, for visitors in the European Economic Area, the United Kingdom, or Switzerland — we will not set Analytics or Advertising cookies until you affirmatively opt in through that tool. You may also block or delete cookies through your browser settings, though doing so may affect Site functionality.

We also honor the Global Privacy Control (GPC) signal, described in Section 10, as a valid opt-out request for California and other applicable U.S. residents.

5. How We Use Your Information

We use personal information to:

  • Respond to inquiries and provide information you request;
  • Operate, maintain, and improve the Site;
  • Communicate with clients and prospective clients, including by SMS if you have opted in;
  • Process payments through LawPay;
  • Measure and improve our advertising and marketing;
  • Comply with legal, regulatory, and professional obligations; and
  • Protect the security and integrity of the Site.

We do not use Site visitor information to form an attorney-client relationship. Submitting information through the Site does not create an attorney-client relationship, and information sent before we confirm we can represent you (including confirming there is no conflict of interest) may not be treated as confidential.

6. Legal Bases for Processing (EEA/UK Visitors)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, our legal bases for processing your personal information under the GDPR/UK GDPR are:

  • Consent — for Analytics and Advertising cookies, and for SMS marketing, which you may withdraw at any time;
  • Legitimate interests — to operate and secure the Site, respond to inquiries, and understand aggregate Site usage, balanced against your rights and interests;
  • Contract — to provide services or process payments where you are a client; and
  • Legal obligation — to comply with applicable law, including our professional obligations as attorneys.

7. How We Share Information

We do not sell personal information for money. We share personal information with:

  • Service providers who process data on our behalf, including our website host, Google (Tag Manager/Analytics/Ads), Meta Platforms, Inc. (Pixel), our SMS platform provider, and LawPay (payment processing);
  • Professional advisors and regulators, where required by law or professional obligation;
  • Successors, in the event of a merger, acquisition, or sale of firm assets; and
  • Law enforcement or other parties, where required to comply with a legal obligation, protect our rights, or protect the safety of any person.

Because our use of the Meta Pixel and certain Google advertising tags may constitute a “sale” or “share” of personal information for cross-context behavioral advertising under the CCPA/CPRA, see Section 9 for your opt-out rights.

8. International Data Transfers

The Site is hosted in the United States, and personal information collected through the Site is processed in the United States. The Site and its marketing are directed to visitors in the United States and are not targeted to individuals in the European Economic Area, the United Kingdom, or Switzerland. To the extent applicable data protection law nonetheless applies to a particular instance of Site processing, we extend the rights described in Section 9(A) as a matter of policy.

Separately, where we receive personal information about individuals located in the EEA, UK, or Switzerland in the course of a client engagement — for example, from an associate law firm retaining us to handle U.S. matters on behalf of its client, or in connection with matters we refer to counsel abroad — any international transfer safeguards required by applicable law (such as Standard Contractual Clauses) are addressed in the engagement or data-processing terms with the relevant firm, rather than in this website Privacy Policy.

9. Your Privacy Rights

A. If You Are in the EEA, UK, or Switzerland

You have the right to:

  • Access the personal information we hold about you;
  • Correct inaccurate information;
  • Request erasure of your information;
  • Restrict or object to our processing;
  • Receive your information in a portable format; and
  • Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal.

To exercise these rights, contact us using the information in Section 15. You also have the right to lodge a complaint with your local data protection supervisory authority.

B. If You Are a California Resident (CCPA/CPRA)

You have the right to:

  • Know what personal information we have collected, used, disclosed, and (where applicable) sold or shared, and the categories of sources and third parties involved;
  • Delete personal information we have collected from you, subject to certain exceptions;
  • Correct inaccurate personal information;
  • Opt out of the sale or sharing of your personal information, including opting out of cross-context behavioral advertising delivered through the Meta Pixel and similar advertising tags;
  • Limit the use and disclosure of sensitive personal information, to the extent we collect any; and
  • Not be discriminated against for exercising any of these rights.

To opt out of sale/sharing, use the “Do Not Sell or Share My Personal Information” link in the Site footer, adjust your cookie preferences as described in Section 4, or contact us using the information in Section 15. We honor the Global Privacy Control (GPC) signal as a valid opt-out request. You may also designate an authorized agent to submit a request on your behalf. We will respond to verifiable requests within the time required by law (generally 45 days, extendable once by an additional 45 days).

C. Other U.S. State Privacy Rights

Residents of certain other states with comprehensive privacy laws (currently including Colorado, Connecticut, Virginia, Utah, and others as they take effect) may have similar rights to access, correct, delete, and opt out of the sale of personal information or targeted advertising, and to appeal a denied request. Contact us using the information in Section 15 to exercise these rights; we will honor valid requests and, where required, the GPC signal as an opt-out of targeted advertising.

D. Nevada Residents

Nevada residents may opt out of the sale of certain “covered information” as defined by Nevada law by contacting us using the information in Section 15, although we do not currently sell covered information as defined under that law.

10. Global Privacy Control (GPC)

The Site is configured to detect and honor the Global Privacy Control signal. When we detect a GPC signal from your browser, we treat it as a valid request to opt out of the sale/sharing of your personal information and targeted advertising, consistent with Section 9. GPC is distinct from your browser’s general “Do Not Track” setting; because there is no common industry standard for Do Not Track, we do not currently respond to Do Not Track signals separately from GPC.

11. Data Retention

We retain personal information collected through the Site for as long as reasonably necessary for the purposes described in this policy, or as required by applicable law, professional responsibility rules, or our document retention policies. Analytics data is generally retained in aggregate or pseudonymous form in line with the retention period configured in our analytics platform.

12. SMS/Text Messaging Communications

If you opt in to receive SMS/text messages from ADD+G, we use your mobile number solely to communicate with you as described in our separate SMS Terms and Conditions, available at allendyer.com/terms-and-conditions/. Your mobile number and related information will not be shared with third parties except as required by law or as necessary to deliver the messages (for example, our SMS platform provider). You may opt out at any time by replying STOP to any message.

13. Children’s Privacy

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us using the information in Section 15, and we will take reasonable steps to delete it.

14. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Text messages, in particular, are not encrypted and should not be used to send confidential or sensitive information.

The Site may link to third-party websites we do not control. This Privacy Policy does not apply to those sites, and we encourage you to review their privacy policies separately.

We may update this Privacy Policy from time to time. The “Last Updated” date below reflects the most recent revision. Material changes will be posted on this page and, where required by law, we will provide additional notice or obtain your consent.
